Erbs Palsy is a serious birth injury that is usually caused by medical malpractice or obstetrical malpractice. Infants suffer Erbs Palsy when excess force was applied to their head and necks during the delivery process. The Erbs Palsy injury can be caused during vaginal delivery and during C-section delivery.
Many times, Erb’s Palsy happens when the child is large and cannot fit through the birth canal. Often an event called shoulder dystocia prevents the delivery. Obstetricians are trained in special procedures to use if they are faced with shoulder dystocia. However, pulling the baby’s head or twisting the head in an effort to dislodge the “stuck” baby are not appropriate procedures. The twisting and pulling causes the nerves in the neck leading to the arm to be torn and directly causes the Erb’s Palsy injury.
Because large babies are known to be at risk for shoulder dystocia doctors have an obligation to determine the size of the baby before delivery and to anticipate whether there is a risk to allowing the vaginal delivery to proceed. For example, doctors and obstetricians know that a large baby (referred to as a macrosomic baby or fetus) is often found when the mother has gestational diabetes or is obese, if the mother goes into labor after the due date, and when the labor is taking longer than usual or expected. When one of the known risk factors for Erb’s Palsy is present, the obstetrician should be extra careful during the delivery, be prepared to use the appropriate special maneuvers during delivery, and consider performing a C-section and should have such a discussion with the parents.
Children with Erb’s Palsy have life long problems with movement of the arm and with the ability to grasp or to do fine motor tasks with the hand. Many times, the muscles do not develop normally and the children will have a shortened arm and less muscle mass than the normal arm. Children with Erb’s Palsy often need years of physical therapy and occupational therapy. Sometimes surgery is recommended. As adults, those affected by Erb’s Palsy may experience lost income because they are not able to type or use a keyboard which can limit their employment opportunities.
